Retargeting.com Terms of Service and Credit Card Charge Authorization

This agreement ("Agreement") describes the terms and conditions applicable to your use of the Retargeting.com Service (the "Service") which is operated by SpecificMEDIA, Inc. By using the Service you ("You"), accept these terms and conditions and agree to be bound by them (the "Agreement"). We may amend this Agreement at any time by posting the amended terms on the Service, and all amendments shall supercede this Agreement and be effective regarding your use of the Service immediately upon posting.

The Service

SpecificMEDIA, Inc. will display your advertisements and target those advertisements only to users who have visited your site where you have placed our "Retargeting Pixel" as per SpecificMEDIA, Inc's instructions. You must place our "Retargeting Pixel" on your pages in order to display advertisements to your users. The fees you pay entitle you to 10,000 advertising impressions per month as measured by SpecificMEDIA, Inc's ad server technology. We reserve the right to deny service to sites deemed inappropriate for our network publishers. These include adult, pornographic, racist or religious sites or any other site deemed inappropriate by SpecificMEDIA, Inc. personnel. If your site is refused service, your credit card will not be charged.

Payments and auto-renewal

You authorize SpecificMEDIA, Inc. to charge your credit card in the amount of $19.95 for each month of Service after your 30 day trial period has elapsed. By providing us with credit card information, you warrant that you are authorized to use the credit card. If it is discovered that you did not have the authority to use the credit card you gave us, you indemnify and hold harmless SpecificMEDIA, Inc. of any actions that the card holder may take against us. You promise to reimburse any legal expenses we may incur as a result of using the credit card information you give us.

Cancellation Policy

If you cancel your membership within 30 days of your initial sign up date, your credit card will not be charged. To qualify for a cancellation within the trial period, you will need to use one of the following methods:

If you choose to cancel your service after your trial period has elapsed, you will need to use one of the following methods

Disclaimer of Warranty/Limitation of Liability/Indemnity

Factors beyond our control can affect the delivery of Service, therefore, SpecificMEDIA, Inc. does not warrant or guarantee the accuracy of the service, completeness of the service. USE OF THE SERVICE IS FURNISHED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, OF ANY KIND. SpecificMEDIA, Inc. SPECIFICALLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, WHATSOEVER INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

In using the Service, You agree to release SpecificMEDIA, Inc. and its agents and employees from any and all claims, demands and damages (actual, special and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such use of the Service. Furthermore, in using the Service, You agree to defend, indemnify and hold the Service and SpecificMEDIA, Inc. harmless from and against any and all liabilities, losses, damages, costs and expenses including reasonable attorneys fees and court costs associated with any claim or action brought against the Service, SpecificMEDIA, Inc. as a result of, or arising from, your use of the Service or your breach of this Agreement.

General. This Agreement will be deemed to have been executed and delivered in the City of Irvine, County of Orange, State of California, USA and any action or proceeding in connection with this Agreement, including, without limitation, its validity, must be brought in the courts of the State of California, USA. SpecificMEDIA, Inc. may assign this agreement freely. This Agreement sets forth the entire understanding and agreement between the parties with respect to the Service and the subject matter hereof.
